TERMS AND CONDITIONS OF USE

1.0 General Provisions
1.1 This online store, LA NUVOLA LAB is owned by LA NUVOLA DI GABRIELLI ROSELLA with registered office in MASSA (MS) Via Cavour, 61 - VAT number 01412570457 and CF GBRRLL60H70D730Q.
1.2 These general terms and conditions of contract (hereinafter, "General Conditions") govern the relationship between the customer (hereinafter, "Customer") and LA NUVOLA LAB (jointly, hereinafter, "Parties") for the purchase of LA NUVOLA products (hereinafter, "Products") made available from time to time for this purpose in the Online Store; and concern exclusively the orders processed independently with direct purchase on this website and make no reference whatsoever to items ordered on commission through the different channels used for the sale of our products. The language available for concluding the contract is Italian.
1.3 The Customer is required to carefully read the terms and conditions of the “General Conditions” that have been made available to him on the Store, in order to allow their storage and reproduction pursuant to art. 12 of Legislative Decree 9 April 2003, n. 70. (Implementation of Directive 2000/31/EC).
1.4 Contracts concluded with LA NUVOLA LAB, by accessing the Store, are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, n. 206 (Consumer Code) and by Legislative Decree 9 April 2003, n. 70 (Implementation of Directive 2000/31/EC relating to certain legal aspects of information society services in the internal market, with particular reference to electronic commerce).
2.0 Product Availability
2.1 All Products offered for sale online are subject to availability at the time. LA NUVOLA LAB reserves the right to vary the quantities and/or types of goods that can be purchased at any time. The Customer will be promptly informed if his/her order cannot be fulfilled due to the unavailability of the ordered product.
3.0 Price
3.1 The prices of the Products are expressed in € (Euro). For Products shipped within the European Union, prices include VAT. For Products shipped outside the European Union, prices exclude VAT. Delivery costs may vary depending on promotional activities or not.
3.2 LA NUVOLA LAB constantly verifies that all prices indicated on the Store are correct, without however guaranteeing the absence of errors. In the event that an error is found in the price of a product, LA NUVOLA LAB will give the Customer the possibility of reconfirming the purchase of the Products at the correct price or cancelling it.
4.0 Purchase Methods
4.1 The characteristics and prices of the Products are shown in the offer relating to each individual product present in the Store.
4.2 To purchase the Products, the Customer must complete and send to LA NUVOLA LAB the purchase order form in electronic format, following the instructions contained in the Store. After having viewed and accepted the General Conditions, Privacy Policy and conditions on the right of withdrawal, the Customer must select the desired type of payment and send the order. By sending the order to LA NUVOLA LAB, the Customer acknowledges and declares that he has read all the information provided during the purchase procedure and fully accepts the General Conditions, even those referred to via links.
5.0 Conclusion of the contract
5.1 The Contract stipulated between LA NUVOLA LAB and the Customer shall be deemed to be concluded when LA NUVOLA LAB sends you Confirmation of Order Acceptance via email.
5.2 LA NUVOLA LAB will send the Customer, by e-mail, a confirmation of acceptance of the purchase order sent by the Customer, containing a summary of the essential characteristics of the Products purchased, the date of placing the order, the chosen delivery address, the detailed indication of the price, the payment method chosen by the Customer, and the delivery costs. The Customer must promptly verify the content of the communication and immediately report errors or omissions to LA NUVOLA LAB. In the event that the Customer does not receive the confirmation of acceptance of the order within 24 hours of placing the order, he/she is required to promptly contact LA NUVOLA LAB at the address: lanuvolalab@gmail.com
5.3 If the Customer requests it, at the same time as sending the order, LA NUVOLA LAB will issue an invoice for the goods shipped, sending it via email or post to the person placing the order, pursuant to Presidential Decree 445/2000 and Legislative Decree 52/2004. The information provided by the Customer at the time of the order will be used to issue the invoice. No changes to the invoice will be possible after it has been issued.
5.4 Orders will be stored in the Store's database, in compliance with the provisions of Legislative Decree no. 196 of 06.30.2003.
6.0 Payment Methods
6.1 The Customer may pay the price of the Products and the related delivery costs by Credit Card, PayPal, Bank Transfer.
6.2 In case of payment by credit card, the Customer will be directed to the website page of the bank that owns or manages the “online” payment service, to which he/she must communicate his/her credit card details via a connection protected against unauthorized access, through the encrypted transfer of SSL (Secure Socket Layer) data at 128 bit. Such data is not accessible to third parties, LA NUVOLA LAB and/or third parties. For administrative accounting needs, Rosella Gabrielli reserves the right to verify the personal details provided by the Customer. The transaction will be charged only after the debit authorization has been received from the company issuing the credit card used.
7.0 Transport and delivery
7.1 For security reasons, a signature from someone over 18 years of age will be required upon delivery. Deliveries to PO boxes will not be made.
7.2 Delivery costs are the responsibility of the Customer for expenses under €100.00 unless there is a promotion that excludes the charge and are clearly highlighted in the order form. They may vary depending on the shipping method and the destination of the Products. Shipments outside the European Union may be subject to import taxes or customs duties. These amounts, determined at the time of entry of the Product into the destination country, are the responsibility of the recipient and are not calculated in the order total. It is the Customer's responsibility to pay import taxes or customs duties, and other appropriate charges in his/her country of residence.
7.3 Orders will be processed and delivered from Monday to Friday, excluding holidays and national holidays. LA NUVOLA LAB is not responsible for unforeseeable delays, it being understood that, except in cases of force majeure, the Products will be delivered within a maximum period of 30 (thirty) days starting from the day following the day on which the Customer sent the order.
7.4 The presence of the Customer or his representative at the recipient's address indicated in the order is required for the delivery of the goods. Upon delivery of the goods by the Courier, the Customer is required to check: (I) that the number of packages delivered corresponds to that indicated in the transport document (DDT); (II) that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials. Any damage to the packaging and/or the product or the lack of correspondence in the number of packages or indications must be contested immediately, by placing a written control reservation on the Courier's proof of delivery. Once the Courier's document has been signed, the Customer may not raise any objection regarding the external characteristics of the goods delivered. 7.5 If LA NUVOLA LAB is unable to deliver the ordered goods due to the subsequent unavailability, even temporary, of the Products, it will promptly notify the Customer, and in any case no later than 30 (thirty) days, by email. The amount already paid by the Customer will be refunded as soon as possible, and in any case no later than 30 (thirty) days from receipt of the purchase order.
7.6 LA NUVOLA LAB will send the Customer a confirmation email once the Products have been shipped.
8.0 Right of Withdrawal
8.1 Pursuant to art. 64 of Legislative Decree no. 206/2005, the “Consumer” Customer (i.e. a natural person who purchases the goods for purposes other than any business or professional activity carried out) has the right to withdraw from the contract without penalty and without specifying the reason. To exercise the right of withdrawal, the Customer must send a written communication to the following email address: lanuvolalab@gmail.com, containing: I) the expression of the will to exercise the right of withdrawal pursuant to art. 64 of Legislative Decree 206/2005; as amended by Legislative Decree 21/2014 II) the indication of the Products for which the Customer wishes to exercise the right of withdrawal; III) the progressive order number issued at the time of purchase; IV) the data relating to the Customer's bank account. The communication can be sent within 10 (ten) working days from the date of receipt of the Products. The Customer undertakes to return the Products within 5 (five) working days from the date of receipt of the return authorization, to the following address:

8.2 The costs for returning the Product are entirely borne by the customer. It is recommended to ship the Products to be returned using an insured courier in order to track the shipment.
NUVOLA LAB will not be responsible for the refund or compensation for those returned products that are lost, stolen or damaged.
8.3 For orders placed through various channels such as WhatsApp and Instagram, the company applies the exception of Art. 59, paragraph 2, letter c of the Consumer Code.
9.0 Cancellation and modification of orders
9.1 If the Customer wishes to modify or cancel the order submitted, he/she must promptly send an email to the address: lanuvolalab@gmail.com, LA NUVOLA LAB will do everything in its power to satisfy the Customer's request. However, once the Product has been shipped, the order cannot be cancelled or modified. In this case, reference is made to the provisions contained in the previous paragraph 8.1.
10.0 Warranties, Defects of Conformity, Complaints
10.1 If a Product sold by LA NUVOLA LAB presents a defect or non-conformity, the Customer must contact immediately and no later than 60 days (sixty), the Customer service at the address: lanuvolalab@gmail.com indicating in the subject of the email "DEFECT-DEFECTION". LA NUVOLA LAB will provide, in agreement with the Customer, for its replacement or refund, communicating the methods to him.
10.2 If the Customer is not completely satisfied or if there is a discrepancy with the order placed by the Customer, the Customer must keep all the documentation and the Product in its packaging and immediately contact Divini Srl by email at the following address: lanuvolalab@gmail.com LA NUVOLA LAB will provide, in agreement with the Customer, the replacement or refund by communicating the methods.
10.3 “Consumer” customers, as defined in paragraph 8.1, are recognised the consumer rights set out in art. 130 of Legislative Decree 206/05. These rights must be exercised within the terms set out in art. 132 of Legislative Decree 206/05.
11.0 Privacy
11.1 LA NUVOLA LAB declares and guarantees that the Customer's personal data will be processed in accordance with the provisions of Legislative Decree of 06.30.2003 n. 196 and subsequent amendments. The details relating to the methods of data processing are communicated to the Customer at the time of registration referred to in the previous paragraph 4.2.
12.0 Errors and inaccuracies
12.1 LA NUVOLA LAB aims to provide constantly updated information on the Site. However, it is not possible to guarantee that the Store is completely free from any errors. The Store may contain errors, inaccuracies or omissions, some of which may refer to the price and availability of the Product, and to the information sheet of the Product itself. LA NUVOLA LAB reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also reserves the right to change or update the information at any time without prior notice.
13.0 Guarantee of authenticity
13.1 The LA NUVOLA branded products sold online through the site are original.
14.0 Intellectual Property
14.1 The LA NUVOLA brand and the attached logo are the exclusive property of Rosella Gabrielli. No page or content of this Store may be reproduced, transferred, modified, linked and used for public or commercial purposes without prior and express written authorization.
15.0 Applicable law, dispute resolution, competent court
15.1 The conditions of access to the Store are governed by the provisions of Italian law and must be interpreted in accordance with Italian law.
15.2 In the event of a disservice or dispute between LA NUVOLA LAB and the Customer, we hereby guarantee our participation in an attempt at amicable conciliation, which allows a satisfactory agreement to be reached.
15.3 For any action arising from or related to the conditions, navigation or use of the Store, the court of Massa will have jurisdiction.
